Terms of Service

1. Agreement to Terms

By accessing or using ChatGolem ("Service", "Platform", or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

ChatGolem is a Software-as-a-Service (SaaS) platform for AI-based chat moderation, designed primarily for Minecraft servers. It analyzes player messages using a combination of blocklists and third-party AI services to detect advertisements, insults, toxic behavior, and other inappropriate content. The platform provides configuration tools, analytics, and moderation controls via a web dashboard.

3. Eligibility and Account Requirements

You must be at least 16 years old to use this service. By creating an account, you confirm that you are of legal age and have the authority to enter into this agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. AI Processing and Training Data

Important: Messages sent by players on your server are transmitted to third-party AI providers (such as Google Gemini) for processing and moderation analysis. These messages may include player names and UUIDs. While we take reasonable measures to ensure secure handling, we have no control over how these third parties store or use the submitted data.

Training Data Usage: Chat messages processed through our AI moderation system are anonymized (removing all personally identifiable information including player names, UUIDs, server identifiers, and timestamps) and used as training data to improve our AI models and services. This anonymized data:

• Cannot be traced back to specific users, players, or servers
• Remains in our systems for training purposes even after account or server deletion
• Is used solely for improving AI moderation accuracy and developing new features
• May be shared with trusted AI research partners under strict confidentiality agreements

By using ChatGolem's AI features, you acknowledge and agree that such processing and training data usage is required for functionality. If you do not want your messages to be sent to external providers or used for training, you may disable AI features in your server settings, though this will significantly limit moderation capabilities.

5. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Share your API keys or account credentials with unauthorized parties
• Use the Service to process illegal content or facilitate harmful activities
• Attempt to reverse engineer, decompile, or extract our algorithms
• Submit false or misleading information during registration

6. API Keys and Security

You are provided with API keys to connect your server to the ChatGolem platform. These keys must be kept confidential and must not be shared with third parties. You are responsible for:

• Securing your API keys and preventing unauthorized access
• Monitoring usage associated with your keys
• Immediately notifying us of any suspected security breaches
• Rotating keys if compromise is suspected

If abuse, excessive usage, or unauthorized use is detected, we reserve the right to suspend or terminate your account immediately without prior notice.

7. Service Availability and Maintenance

We strive to ensure the availability and stability of our services. However, we reserve the right to:

• Perform scheduled or emergency maintenance at any time
• Temporarily suspend services for technical upgrades
• Modify or discontinue features with reasonable notice

Technical issues—either on our side or with external providers (e.g., AI services, payment processors)—may lead to temporary service interruptions. We are not liable for any losses resulting from downtime or reduced availability.

8. Subscription, Payments, and Billing

Certain features of ChatGolem require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described in your subscription plan
• Keep your payment information current and accurate
• Accept that subscriptions renew automatically unless canceled
• Understand that refunds are subject to our refund policy

Payments are processed securely via Stripe. You authorize us to charge your payment method for all applicable fees. Failure to pay may result in service suspension or termination.

Price Changes: We reserve the right to modify all pricing at any time without prior notice, including but not limited to subscription fees, AI message processing costs, and any other service-related charges. Price changes will take effect immediately for usage-based billing (such as AI message processing) and at your next billing cycle for subscription fees. If you do not agree to the new pricing, you may cancel your subscription or discontinue using the affected services before the new rates take effect.

9. Intellectual Property Rights

The Service, including all content, features, and functionality, is owned by ChatGolem and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not:

• Copy, modify, or distribute our software or content
• Create derivative works based on our Service
• Use our trademarks or branding without permission
• Claim ownership of any part of the Service

10. Data Ownership and Privacy

You retain ownership of the data you submit to our Service, subject to the processing and training data usage described in Section 4. We process your data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to such processing.

11. Account Termination and Data Deletion

You may terminate your account at any time through the dashboard. We may terminate your account for violations of these Terms. Upon termination:

• All associated personal data will be permanently removed from our systems
• Chat logs, analytics, and moderation data will be deleted
• Transaction and payment history will be retained by Stripe as required by law
• Anonymized training data will remain as it cannot be linked back to you
• Outstanding subscription fees remain due

12. Disclaimers and Limitation of Liability

Service Disclaimers: The Service is provided "as is" without warranties of any kind. We do not guarantee that:

• The Service will identify all harmful or inappropriate messages
• AI moderation decisions will be 100% accurate
• The Service will be uninterrupted or error-free
• External AI providers will maintain constant availability

AI Moderation Limitations: Our AI moderation system is probabilistic and may produce false positives or false negatives. You are solely responsible for:

• Final moderation decisions on your server
• Reviewing and overriding AI decisions where necessary
• Implementing additional moderation measures as needed
• Compliance with applicable laws and platform rules

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

13. Indemnification

You agree to indemnify, defend, and hold harmless ChatGolem, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

14. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, available at [Privacy Policy URL]. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

15. Third-Party Services and Content

The Service may integrate with or contain links to third-party services, websites, or content. We are not responsible for:

• The availability or accuracy of third-party services
• Third-party privacy practices or terms of service
• Content or actions of third-party providers
• Disputes between you and third-party providers

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, government actions, or failures of third-party services.

17. Changes to the Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice, and without liability. We may also update these Terms at our discretion. Material changes will be communicated through:

• Email notification to registered users
• Prominent notice on our website
• In-app notifications where applicable

Continued use of the Service after changes have been published constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of Germany, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bonn, Germany.

Before resorting to formal legal proceedings, both parties agree to attempt to resolve disputes through good faith negotiations. If such negotiations fail, disputes may be submitted to mediation before pursuing litigation.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ChatGolem regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
